In defendant's appeal from the district court's judgment revoking his supervised release and sentencing him to eighteen months in prison, the order is affirmed where the fugitive tolling of a defendant's term of supervised release begins when the defendant becomes a fugitive, not at the later time when a warrant was issued for his apprehension. April 7, 2010 - No. 08-50579 - US v. Tello
Defendant's conviction for using a means of interstate commerce to knowingly persuade, induce, entice, or coerce a minor to engage in a sexual activity for which he could be charged with a criminal offense is affirmed where defendant could have been convicted of a criminal offense under California law, even if he intended to engage in sexual activity with the minor only after returning to Arizona.
