When a plaintiff moves for summary judgment and the defendant offers no evidence in response, may the court automatically grant the motion on the basis that there is no genuine dispute of material fact? Read opinion.

April 29, 2010 - 2 CA-SA 2008-0205 - State of Arizona v. Louie Thomas Machado
1. Did the trial court commit reversible error in precluding evidence that suggested a third party committed the murder with which the appellant was charged? 2. Did the court err in precluding on hearsay grounds certain out-of-court statements the appellant had made to police? 3. Was the appellant entitled to present the results of a polygraph test that suggested he did not shoot the victim? 4. Did the trial court err in instructing the jury on issues of eyewitness identification and reasonable doubt. Read opinion.

May 6, 2010 - No. 08-16005 - Au-Tomotive Gold Inc. v. Volkswagen of Am., Inc.
In a declaratory judgment action involving whether the sale by plaintiff of marquee license plates bearing Volkswagen badges purchased from Volkswagen constitutes trademark infringement, or whether the sale of the plates is protected by the "first sale" doctrine, summary judgment for Volkswagen is affirmed where the "first sale" doctrine did not provide a defense because plaintiff's marquee license plates create a likelihood of confusion as to their origin. April 30, 2010 - No. 09-15864 - Marciano Plata v. Schwarzenegger
In a class action challenge deficiencies in prison medical care that allegedly violated the Eighth Amendment and the Americans with Disabilities Act, the district court's order appointing a receiver is affirmed where: 1) the Prison Litigation Reform Act did not deprive the district court of its equitable power to appoint a receiver in prison litigation; 2) the district court correctly found that a receivership was the least intrusive means of remedying constitutional violations in prisoner health care; and 3) the court lacked jurisdiction to review the district court's refusal to terminate the receiver's construction plan.
